1. Promoter: the Promoter is Scottish Power UK Plc, 320 St. Vincent Street, Glasgow, Scotland, G2 5AD (the "Promoter");
Promoter Affiliates: any officer, director or employee of the Promoter ("Promoter Affiliates");
Promoter Group Company: any subsidiary or holding company from time to time of the Promoter and any subsidiary from time to time of a holding company of that company, the terms "holding company" and "subsidiary" being as defined in section 1159 of the Companies Act 2006 ("Promoter Group Company"); and
Promoter Group Company Affiliates: any officer, director or employee of any Promoter Group Company ("Promoter Group Company Affiliates").
2. How to enter:
a. Entrants may enter this competition by filling out the entry cards found at the visitor centre and submitting them via the competition "post box" at the visitor centre.
b. Entrants must be UK residents, aged 18 years or over. This promotion is open to any Promoter Affiliates or Promoter Group Company Affiliates or anyone else connected with this promotion.
c. One entry is allowed per person. Entries submitted on behalf of another person will not be accepted and joint submissions are not allowed. Incomplete, illegible, misdirected or late entries will not be accepted.
d. No purchase is necessary.
3. Promotion Period: The promotion is open to entries from 00.00 BST on 23rd September 2024 until 17.00 BST on 7th October 2024.
4. Prize:
a. The Promoter is offering entrants the chance to win one Electric Bike from 'Cyclestation'
b. The prize is non-refundable, non-transferable and non-exchangeable and there is no cash alternative offered. The Promoter reserves the right to offer an alternative prize of equal or greater value.
5. How are the winners selected and notified:
a. There will be one winner selected from entries submitted to the Whitelee Visitor Centre. The winner will be selected from all valid entries received during the Promotion Period by random selection.
b. The winner will be contacted within 2 business days of the closing date via email, using the contact details provided with their entry, and will be asked to provide their full name and address. If the winner declines the prize or fails to respond within the required period, they forfeit any right to the prize. If the winner fails to respond within 4 business days of this initial contact, a new winner will be selected from the pool of runners up. A prize winner may be required to submit valid identification before receiving their prize.
c. The prize will be despatched via registered post to the address supplied to the Promoter within 15 business days of notification, in accordance with paragraph 6b. above, and the winners will be required to sign to acknowledge receipt.
6. The Promoter reserves the right to discount any inappropriate or offensive entries and to disqualify any entries if the Promoter, at its sole discretion, believes that there has been an attempt to manipulate, abuse or tamper with the operation of the promotion.
7. In the event of unforeseen circumstances or circumstances outside its reasonable control, the Promoter reserves the right to modify or discontinue, temporarily or permanently, this promotion without prior notice.
8. Entrants agree to be bound by the decisions of the Promoter, which are final in all matters relating to the promotion. No correspondence will be entered into in respect of the Promoter's decisions.
9. The entrant hereby grants to the Promoter, a non-exclusive, fully paid up, royalty free, perpetual, sub-licensable licence to use, adapt or develop any intellectual property in entries submitted by the entrant in connection with the promotion. The Promoter and the Promoter Affiliates do not accept any responsibility for any infringement of any third-party intellectual property rights caused by entrants entering this promotion.
10. For the avoidance of doubt, the Promoter Group Companies, the Promoter Affiliates and Promoter Group Company Affiliates shall have no liability under these terms and conditions. Any liability for breach of these terms and conditions or in connection with the competition shall be borne by the Promoter in accordance with the terms of paragraphs 11 to 13 (inclusive) below.
11. Nothing in these terms excludes the Promoter's liability for death or personal injury caused by its negligence, or for fraud, or any other liability that the Promoter may not exclude by law. Subject to that, the Promoter will not be liable for any direct loss or for any indirect, special or consequential loss, or for loss of profits or loss of reputation, or any expense or damage which is suffered or sustained in connection with this promotion or accepting or using any prize, including any loss incurred as a result of any delay and/or failure to perform any obligation to the winner or other entrants that is caused by:
a. technical problems of any kind which may limit or prevent any person's participation in the promotion;
b. any loss or damage arising from or in connection with the allocation or enjoyment of a prize;
c. any act or omission of any third party, particularly any third party involved in the provision of services relevant to the prize; or
d. any other events beyond the Promoter's control that may cause the promotion to be disrupted or corrupted or may lead to loss of, or damage to, the winner or to the prize.
12. The Promoter shall to the maximum extent permitted by law have no liability, grants no warranty and makes no representation whatsoever in respect of the quality, safety or suitability of the contents of any prize awarded pursuant to paragraph 5a. Cyclestation shall, at all times, remain liable for the contents of any prize awarded pursuant to paragraph 5a.
13. Subject to paragraph 11 above, the Promoter's entire liability in connection with the promotion shall be limited to the retail cost of one prize referred to at paragraph 5 above.
14. If any of these terms and conditions are found by a court or regulator to be invalid or unenforceable the remaining other provisions shall continue to apply.
15. This promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Instagram, X/ Twitter, LinkedIn or any other social media channel on which the competition may be advertised. By entering, entrants acknowledge that Facebook, Instagram and X/Twitter do not bear any responsibility for this promotion and, to the maximum extent permitted by law, entrants release Facebook, Instagram and X/Twitter or LinkedIn from any liability whatsoever in connection with this promotion.
16. The Promoter shall use entrants' personal data for the purposes of carrying out the promotion, and in the case of winners' data, as set out in the Promoter's privacy notice in Schedule 2 below. The entrant recognises that, with respect to any individuals featured in any photograph, the entrant is responsible for making those individuals aware of how the photographs may be used, and for obtaining any necessary consent before such photographs are submitted in connection with this promotion, and by submitting a photograph, the entrant confirms that it has done so.
17. Subject to the winners' rights under applicable data protection legislation, the Promoter shall be entitled to use and feature the name of the winner and runner up for publicity purposes and prize winners agree that they will participate in any reasonable publicity arranged by the Promoter or its agencies.
18. The Promoter will make the prize winners' surname and county of residence available on request to anyone who sends a stamped self-addressed envelope to the Promoter within 10 weeks of the end of the Promotion Period, as required by the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the "Code"). The Promoter may also be asked to provide the same details to the Advertising Standards Authority ("ASA") who publish and enforce the Code. This use of the prize winners' data is necessary for the Promoter's legitimate interests in complying with the Code. Prize winners who do not wish the Promoter to disclose these details to members of the public who request them, should let the Promoter know as soon as possible by emailing: dataprotection_corporate@scottishpower.com. The prize winner may also object to the disclosure to the ASA by emailing the same address, giving reasons. The Promoter will take these reasons into account if the ASA asks for the prize winners' details. Please note, however, that the Promoter may nevertheless still be required to disclose this information to the ASA. This may happen where, for example, the Promoter is required to demonstrate that a valid award took place.
19. These terms and conditions shall be governed by and construed in accordance with Scots Law and the parties agree that any dispute or action arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of Scotland.

SCOTTISHPOWER 15 YEARS OF WHITELEE VISITOR CENTRE COMPETITION WHAT INFORMATION IS COLLECTED AND WHY
ScottishPower will collect your name and contact details for the purposes of entering the Competition and processing the winning entry. In particular, we collect this personal data to ensure compliance with our Terms and Conditions including:
- To ensure that no more than one entry is submitted per participant;
- SPR would also like to meet with the winner when collecting their prize, and to capture photos and a short video clip of them with the prize for use across social media channels.
WINNERS' DATA
ScottishPower has appointed Cyclestation to provide the winners with their prizes. If you are a winner, we will ask for your name and address and share this data with Cyclestation for the purpose of issuing the prizes. ScottishPower will retain your personal data until the prizes are received by the winners, after which all entries will be deleted. If you do not share this personal data prescribed by this privacy policy, or object to this processing you will not be able to participate in the Competition.
LAWFUL BASIS
This personal data is collected in accordance with the UK General Data Protection Regulation ("UK GDPR") and the lawful basis upon which we process your personal data is:
- Legal obligation - the processing is necessary for us to comply with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the "Code") or to the Advertising Standards Authority who publish and enforce the Code applicable to the Competition; and
- Legitimate interests - the processing is necessary to review entry to the Competition, announce a winner and promote the winning entry. In respect of personal data collected pursuant to the Competition, ScottishPower will not:
- Transfer your personal data outside of the European Economic Area;
- Use automated decision-making.
